These Terms of Service ("Terms") govern your access to and use of the JobPlanNow project management, dispatch, estimating, invoicing, and related services (the "Service"), provided by JobPlanNow, LLC ("JobPlanNow," "we," "us," or "our"). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
You must be at least 18 years old and able to form a binding contract to use the Service. You are responsible for the accuracy of your account information, for keeping your login credentials secure, and for all activity under your account.
JobPlanNow provides software for managing construction and field-service work, including project boards, scheduling, dispatch, estimates, invoices, payments, and related features. We may add, change, or remove features over time. The Service is currently offered on an evolving basis and may include beta features.
You agree not to:
You retain ownership of the data and content you submit to the Service ("Your Content"). You grant us a limited license to host, process, and display Your Content solely to operate and improve the Service and to provide the features you request. You are responsible for Your Content and for having the rights to use it.
The Service integrates with third-party services that are governed by their own terms and privacy policies, including but not limited to:
We are not responsible for third-party services, and your use of them is subject to their terms. Connecting a third-party account authorizes us to exchange data with it as needed to provide the features you enable.
Some features of the Service may require a paid subscription. Where fees apply, they will be disclosed before you subscribe. Unless stated otherwise, fees are billed in advance, are non-refundable except as required by law, and you authorize us (and our payment processor) to charge your selected payment method. You can cancel a subscription as described in the Service; cancellation stops future charges and takes effect at the end of the current billing period.
The Service, including its software, design, and content (excluding Your Content), is owned by JobPlanNow and its licensors and is protected by intellectual-property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service in accordance with these Terms.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE. JobPlanNow is a software tool and does not provide accounting, tax, legal, or professional advice.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, JobPlanNow AND ITS AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUES, OR DATA, ARISING FROM OR RELATED TO YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE WILL NOT EXCEED THE AMOUNTS YOU PAID US FOR THE SERVICE IN THE TWELVE MONTHS PRECEDING THE CLAIM.
You agree to indemnify and hold harmless JobPlanNow from claims, damages, and expenses (including reasonable attorneys' fees) arising from Your Content, your use of the Service, or your violation of these Terms.
You may stop using the Service at any time. We may suspend or terminate your access if you violate these Terms or to protect the Service. Upon termination, your right to use the Service ends; provisions that by their nature should survive (such as ownership, disclaimers, and limitation of liability) will survive.
These Terms are governed by the laws of the State of Utah, without regard to its conflict-of-laws rules. Any dispute will be resolved in the state or federal courts located in Utah, and you consent to their jurisdiction.
We may update these Terms from time to time. We will post the updated version with a new effective date and, where appropriate, provide additional notice. Continued use of the Service after changes take effect constitutes acceptance.
